The rules for using Dexto

1. The open beta

Dexto is an early-access service. Features may change, be unavailable, or be removed without notice. You understand that outputs may be inaccurate, incomplete, offensive, or unsuitable for your purpose, and you are responsible for reviewing them before relying on, sharing, or acting on them.

2. Accounts

Keep your account credentials secure, provide accurate account information, and promptly tell us about unauthorized use. You are responsible for activity under your account to the extent permitted by law.

3. Your content and permissions

You retain any rights you have in the content you submit to the Services ("Customer Content"). You grant us a non-exclusive, worldwide, limited license to host, copy, process, transmit, and display Customer Content only as needed to provide, secure, and improve the Services, comply with law, and enforce these Terms. You represent that you have the rights and permissions needed to give us that license and to direct any connected service.

We do not use Customer Content to train Dexto models, and we do not authorize third-party model providers to train their models on Customer Content, unless you separately and explicitly opt in.

4. Acceptable use and connected services

You must use the Services lawfully and must not use them to harm people or systems, violate another person's rights, bypass security controls, distribute malware, or cause Dexto to act without authorization. The Services can interact with third-party services you choose to connect. Your use of those services is governed by their terms and privacy notices. We are not responsible for their availability or their handling of data after you direct an action to them.

5. Payments and credits

Paid features, credits, prices, taxes, and payment terms are presented when you make a purchase. Credits are prepaid and applied to eligible usage. Except where required by law or stated at purchase, payments and unused credits are non-refundable and have no cash value.

6. Privacy

Our Privacy Policy explains how we process personal data.

7. Suspension and termination

You may stop using the Services at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure for us or others, or if the beta is discontinued. Sections that by their nature should survive termination will survive.

8. Disclaimers and liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUFFLE AI AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

9. Governing law and venue

Delaware law governs these Terms and any dispute, without regard to conflict of laws rules. Except where applicable law requires otherwise, you and Truffle AI agree that the state and federal courts located in Delaware have exclusive jurisdiction over disputes arising from these Terms or the Services.

10. Changes and contact

We may update these Terms as the beta changes. Updated Terms become effective when posted unless we state a later date. If you do not agree to an update, stop using the Services. Questions about these Terms can be sent to founders@dexto.ai.
